Welcome to the terms and conditions ("Terms") for Furkot Pass. These Terms are between you and LEWYHALS LLC ("the Company" or "Us") and govern our respective rights and obligations. Please note that your use of Furkot trip planner website and Furkot Pass are also governed by the agreements listed and linked to below, as well as all other applicable terms, conditions, limitations, and requirements on the furkot.com website, all of which (as changed over time) are incorporated into these Terms. If you acquire Furkot Pass, you accept these terms, conditions, limitations and requirements.

1. Benefits ¶

Furkot Pass entitles its holder to a set of unique benefits. All Furkot features available as benefits exclusively to Furkot Pass holders are listed in the Furkot Pass section of our help.

2. Limitations ¶

We reserve the right to accept or refuse Furkot Pass at our discretion.

We may send you email and other communications related to Furkot Pass (regardless of any settings or preferences related to your Furkot account).

You may not transfer or assign your Furkot Pass or any Furkot Pass benefits, except as allowed in these terms.

We may, at our sole and absolute discretion, add or remove Furkot Pass benefits including extending features available exclusively to Furkot Pass holders to all Furkot users.

3. Cancellation and Refunds ¶

You may cancel your Furkot Pass at any time by contacting us at trips@furkot.com. If you cancel within 3 business days of purchasing your Furkot Pass, we will refund your full fee, provided that we may charge you (or withhold from your refund) the value of Furkot Pass benefits used by you and your account during this 3-business day period. If you cancel at any other time, we will refund your full fee only if you and your account did not take advantage of Furkot Pass benefits. Otherwise we will give you a prorated refund based on the number of full months remaining until the expiration date of your Furkot Pass.

Furkot Passes offered on a trial basis or redeemed through a Furkot Pass coupon code or reward are not refundable.

4. Fees and Renewal ¶

Furkot Pass is valid for a defined time period until its expiration date. The duration of Furkot Pass validity and the fee for Furkot Pass are stated in the Furkot Pass section of our help. The Furkot Pass fee is non-refundable except as expressly set forth in these Terms. Taxes may apply on the pass fee.

Furkot Pass does not automatically renew. Furkot Pass can be renewed if it expires in 45 days or less.

5. Free Trials ¶

We may offer Furkot Pass without charge on a trial basis. Free trial eligibility is determined by us at our sole and absolute discretion and we may limit eligibility or duration to prevent free trial abuse. You are not obligated to purchase Furkot Pass at the end of the free trial period.

Furkot Pass granted on the free trial basis is subject to these Terms except as otherwise stated in the free trial offer. Furkot Pass granted on the free trial basis has no monetary value and is not refundable.

6. Coupons ¶

We may offer certain users coupons redeemable for Furkot Pass without charge. The eligibility and the duration of Furkot Pass redeemable through Furkot Pass coupon code is at our sole and absolute discretion.

Furkot Pass redeemed through Furkot Pass coupon code is subject to these Terms except as otherwise stated in the coupon offer. Furkot Pass redeemed through Furkot Pass coupon code has no monetary value and is not refundable.

7. Rewards ¶

We may offer Furkot Pass without charge as a reward for engaging in commissionable transactions with our partners. Receiving a commission by us does not create an obligation on our part to offer a reward. The duration of Furkot Pass offered as a reward is at our sole and absolute discretion and we are under no obligation to consider amount of the commission if and when offering a reward.

Furkot Pass redeemed as a reward is subject to these Terms except as otherwise stated in the reward offer. Furkot Pass redeemed as a reward has no monetary value and is not refundable.

8. Agreement Changes ¶

We may at our discretion change these Terms, Furkot Terms and Conditions of Use and Furkot Privacy Policy, or any aspect of Furkot Pass including price, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED USE OF FURKOT PASS HOLDER BENEFITS AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR FURKOT PASS.

9. Termination by Us ¶

We may terminate your Furkot Pass at our discretion without notice. If we do so, we will give you a prorated refund based on the number of full months remaining until the expiration date of your Furkot Pass. However, we will not give any refund for termination related to conduct that we determine, at our discretion, violates these Terms or any applicable law, involves fraud or misuse of the Furkot Pass benefits, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Terms will not constitute a waiver of any of our rights.

10. Limitation of Liability ¶

IN ADDITION TO OTHER LIMITATIONS AND EXCLUSIONS IN FURKOT'S TERMS AND CONDITIONS OF USE, OUR TOTAL LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, WILL NOT EXCEED THE LAST FURKOT PASS FEE YOU PAID. THIS LIMITATION OF LIABILITY WILL APPLY TO THE FULLEST EXTENT PERMITTED BY LAW AND WILL SURVIVE CANCELLATION OR TERMINATION OF YOUR FURKOT PASS.

11. Agreement Changes ¶

We may at our discretion change these Terms, Furkot Terms and Conditions of Use and Furkot Privacy Policy, or any aspect of Furkot Pass, without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED USE OF FURKOT PASS HOLDER BENEFITS AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR FURKOT PASS.

12. Governing Law ¶

Any claim relating to the Furkot Pass shall be governed by the laws of the State of Wyoming without regard to its conflict of law provisions.
